These general terms and conditions apply to all PebEx business transactions. They regulate the contractual relationship between Reto Schneider PebEx and the client.
conclusion of contract
Unless otherwise agreed, offers are valid for 20 days. A contract is normally only concluded when the customer places an order in writing (including e-mail). Orders can be delivered via e-mail, post or by personal delivery. PebEx can refuse to accept orders without giving reasons and can interrupt, shorten or prematurely terminate the execution of an order if the customer makes it difficult or impossible to fulfill the order, or if the customer is in default of payment.
liability
PebEx carries out all orders with the greatest possible care and the necessary quality. However, PebEx cannot accept any liability for the result of its activities. Claims for damages of any kind are expressly excluded.
Privacy and Confidentiality
Since the security of data traffic cannot be absolutely guaranteed, no liability can be accepted for any resulting damage. In particular, no liability is assumed for actions or faults of third parties through which the data is used, changed, deleted or otherwise damaged. PebEx treats all information from customer projects with absolute confidentiality.
cancellation conditions
Consulting: If the client terminates a consulting project prematurely, all expenses incurred up to that point are owed. Even if these have already been carried out in preparation for the omitted work steps.
expenses and third-party costs
Travel expenses based on actual expenditure (train 2 class or car CHF 0.85 per km), meals/accommodation based on actual expenditure. Costs for third-party services such as hotels, translations, test procedures, survey tools and the production of aids are borne by the client, resp. be invoiced.
Executive recruitment
This takes place under PeBex AG according to the invoice and the conditions of PeBex AG.
Severability Clause
Should these regulations or parts of these regulations be or become invalid, the validity of the remaining regulations will not be affected. The ineffective regulation is to be replaced by a regulation that comes as close as possible to its economic purpose.
place of jurisdiction
The terms and conditions (General Terms and Conditions) of PebEx are subject to Swiss law. The exclusive place of jurisdiction is Zug.

Data protection
Data protection, data security and the responsible handling of personal data are important concerns for PebEx. In this data protection declaration, I describe how any personal data can be collected and processed from you, even if you use the online offer and the associated websites, functions and content (hereinafter jointly “online platform”).
Personal data collected and processed to make the online platform available (also from third-party providers)
You can visit the online platform and find out about products and services without telling us who you are. However, as with any connection to a web server, the web hosting provider's server automatically logs and temporarily stores certain technical data. This data is expected to include meta/communication data (namely the IP address and the operating system of your end device and the type of browser you use to access the online platform) and usage data. Insofar as personal data is processed, this is done based on the interest in making the online platform available to you, in offering you the best possible user experience and in guaranteeing the security and stability of the online platform.
Personal data collected and processed to answer your inquiries
If you contact us via the contact form, via the chat function, via social networks, by e-mail or by phone, collect blog comments, the information you submit to us will be collected.
This data includes inventory data (namely name and address), contact data (namely e-mail addresses and telephone numbers), content data (namely text input, etc.), if applicable contract data (namely services used, contract content, contractual communication, names of contact persons ) and, if applicable, payment data (namely bank details, payment history).
The processing of this personal data is based on the interest in responding to your inquiry (including providing the services ordered) and in contacting you with questions and inquiries. Based on our interest in providing information about new developments at PebEx and about products and services, you will receive news reports about them if you are interested. You have the option to opt out of receiving it at any time.
Personal data that can be collected and processed to provide the contractual services
PebEx collects and processes personal data of our contractual partners and interested parties, their customers and employees in order to be able to provide them with the contractual or pre-contractual services. The data processed here, the type, scope and purpose and the necessity of their processing are determined by the underlying contractual relationship. This data includes inventory data (specifically names and addresses), contact data (specifically e-mail addresses and telephone numbers), content data (specifically text entries, photographs, videos), contract data (specifically services used, contract content, contractual communication, names of contact persons ) and payment data (namely bank details, payment history). Personal data that is particularly worthy of protection will only be processed if this is part of a commissioned or contractual processing. When processing the personal data provided to us as part of an order, PebEx acts in accordance with the instructions of the client and the applicable legal requirements.
Personal data collected and processed in the application process
PebEx AG process the applicant data for the purpose and as part of the application process and any employment relationship. The applicant data is processed to fulfill our (pre)contractual obligations as part of the application process.
The application process requires that applicants provide us with the applicant data. The necessary applicant data result from the application process according to practice and necessity. Basically, this includes inventory data (namely names and addresses), contact details (namely e-mail addresses and telephone numbers) and the documents belonging to the application, such as cover letter, curriculum vitae, certificates and references. In addition, applicants can voluntarily provide us with additional information.
By submitting the application to us, the applicants agree to the processing of their data for the purposes of the application process in accordance with the type and scope set out in this data protection declaration.
If made available, applicants can send us their applications using an online form. The data is transmitted to us in encrypted form using state-of-the-art technology. Applicants can also send us their applications via email, with the applicants being responsible for the encryption of the relevant email communication. Liability for the digital communication channels cannot be assumed and is explicitly stipulated.
As part of the application, we offer applicants, based on consent, to be included in our Talend database. We process the applicant data in the context of future job advertisements and the search for employees; they will be deleted at any time and immediately upon request, subject to a successful application for a job posting. Applicants are informed that their consent to the inclusion of the database is voluntary, has no influence on the current application process and that they can revoke this consent at any time for the future.
In the event of a successful application for a job advertisement, the data disclosed by the applicants can be further processed by us and our contractual partners for the purposes of the employment relationship. The applicants' data will be deleted if the applicant withdraws their application and requests this. Invoices for any business transactions and travel expenses are archived in accordance with the applicable legal requirements.
Use of cookies
Our host provider may use cookies on the online platform to offer you the best possible user experience and to obtain pointers to improve products and services. Cookies are text files that are downloaded to your end device when you visit a website.
PebEx has no influence on this type of use of cookies and cannot influence it, in this respect also no liability.
Cookies serve the purpose of identifying the individual end devices (or the browsers installed on them) through which a user accesses the online platform. For this purpose, the cookie generates an identification number (cookie ID) when it is activated. Some of the cookies used on online platforms (so-called session cookies) are necessary to enable the use of certain functions (e.g. live chat). Session cookies store the contents of a shopping cart, for example, and are deleted as soon as you leave the online platform and close your browser. In addition, so-called persistent cookies can be used to analyze the use of the online platform, to optimize products and services and to enable online marketing services. Persistent cookies are expected to remain on your end device after you close your browser. Depending on the technology used, the opt-out may require the setting of a cookie on your end device or the installation of a browser plug-in in individual cases. If all cookies are deleted, this can result in an opt-out being prevented in individual cases.
Data collection/processing to analyze and improve the use of the online platform
PebEx reserves the right to use the analysis services Google Analytics from Google LL.C. ("Google") and the host to evaluate the use of the online platform and to obtain information to improve our services. Google Analytics and Host use cookies to evaluate your use of the online platform, to create reports on user activities on the online platform and to provide us with other services related to the use of the online platform. There is a legitimate interest in this. According to the information provided, Google and the host store the information collected via cookies in an anonymous form and process it in an aggregated form. PebEx has no influence on this and must comply with the provisions of the provider.

Possible use of social media
At best, PebEx offers online platform sharing links for sharing content on social media platforms such as LinkedIn, Xing, Facebook, Twitter and other providers. There is a legitimate interest in this. The respective providers are responsible for the data protection-compliant operation of the social networks and their respective data protection declarations apply. PebEx has no influence or access to the cookies that social network providers set after clicking on the sharing link.
Data collection for targeted addressing
PebEx may use Google's advertising technologies (e.g. Google AdWords and conversion measurement) to target marketing measures relating to products and services to potential customers when they use other websites. This serves the legitimate interest of advertising products and services. You can find more information about how Google uses cookies and your choices on the Google websites. Their regulations apply.
Other Third-Party Services
PebEx can use content or service offers from third parties within the online platform based on their legitimate interest (ie interest in the analysis, optimization and economic operation of the online platform) in order to integrate their content and services, such as videos or fonts (hereinafter collectively “Content”). This always presupposes that the third-party providers of this content perceive the IP address of the user, since without the IP address they could not send the content to their browser. The IP address is therefore required for the display of this content.
Google Maps
Based on the interest in providing you with information about the locations, PebEx uses the Google Maps map service on the online platform. The use of the functions of Google Maps requires the storage of your IP address. This is usually transmitted to a Google server in the USA and stored there. PebEx has no control over this data transfer.
YouTube
If necessary, PebEx integrates online platform videos from the “YouTube” platform from Google and “Vimeo”. There is a legitimate interest in this. The handling of your data depends on their regulations - see their website.
Personal data in the context of the online presence in social networks
PebEx maintains online presences within social networks in order to be able to communicate with customers, interested parties and users who are active there and to inform them about our products and services. There is a legitimate interest in this. The respective providers are responsible for the data protection-compliant operation of the social networks and their respective data protection declarations apply. Unless otherwise stated in our data protection declaration, PebEx processes the personal data disclosed by customers, interested parties and users active in the social networks for the purpose of communicating with them.
Processing, protecting and storing personal data
PebEx collects and processes your personal data responsibly, only for the purposes described in this privacy policy and in accordance with the Swiss Data Protection Act (DSG) and other applicable laws. In the interests of confidentiality, integrity and contractual availability of personal data, PebEx takes appropriate and reasonable technical and organizational measures. Our providers for the systems are well-known providers with a good reputation who have to guarantee IT security in accordance with their contractual provisions. PebEx stores the personal data only to the extent and for as long as this is necessary to fulfill the purposes for which the personal data was collected, PebEx has a legitimate interest in the storage or is legally obliged to do so.
Disclosure of personal data
If personal data is disclosed to other people and companies (processors or third parties) in the course of processing, transmitted to them or otherwise granted access to personal data, this is only done on the basis of legal permission (e.g. if personal data is transmitted to third parties, such as to payment service providers, is required to fulfill the contract), you have consented, a legal obligation provides for this or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.). If personal data is processed in a third country (i.e. outside of Switzerland, the European Union [EU] or the European Economic Area [EEA]) or this occurs as part of the use of third-party services or disclosure or transmission of personal data to third parties, this takes place in Compliance with the applicable legal requirements.
Your rights in relation to your personal data
You have the right to receive information about the personal data we are processing about you and a right to have your personal data corrected. You also have the right to have your personal data deleted and to object to the processing of personal data. Please note that exceptions apply to these rights. In particular, PebEx may have to process and store your personal data in order to fulfill a contract with you, your company or organization, to protect its own legitimate interests such as the assertion, exercise or defense of legal claims, or to comply with legal obligations. As far as legally permissible, your data protection-related requests (e.g. requests for information and deletion) can also be rejected or only partially met. However, you have the right to lodge a complaint with a competent supervisory authority.
